22 ~ Checking Cops at the Scene

There
are three simple rules when facing a line of questioning:
Be
quiet, shut up and don't say anything! Let the damn fool
shoot himself in the foot.
"Everything
that you say can and
WILL
be used AGAINST you."
The state cannot take jurisdiction if you don't state a name. Their
goal is to get you to volunteer evidence to incriminat yourself. The
Master asks the questions, the slave answers the questions. Bah!
Also, one should always answer a question with a question, if
possible. Do not volunteer any information or into their
jurisdiction. In they can't build a case if you don't give them any
information about yourself. Oftentimes fools volunteer themselves
right into handcuffs.
Get
in the habit of scanning badges and cars for names and unit
numbers and speaking them into your recorder like a reporter
because details are everything.
A
Roman officer cannot bind (arrest) a Roman citizen. Acts 22:29
If
an agent stops you and begins questioning you, don't get all nervous
and reactive because they love it when you’re skeer'd. It makes
them feel good and gives them an excuse to say you were not
cooperative.
Say
a prayer. Tell God that you know that he has made this happen for
a good reason and that you trust Him.
Don't
roll down your window all the way until you've got the recorder
rolling and let the employee know you are recording him.
Sometimes that alone is enough to get him to respect your rights. If
he asks you why, tell him that you saw it on the news that there have
been a lot of incidents of police brutality on the highways and you
are just making sure he doesn't step out of line.
Silence
is golden but the most powerful statement that you can say at any
given time is:
“That
line of questioning assumes facts not in evidence.”
Say
it now: “That line of questioning assumes facts not in
evidence.”
Get
in the habit of saying it.
“That
line of questioning assumes facts not in evidence.”
Say
it again.
“That
line of questioning assumes facts not in evidence.”
Make
him state his name, rank, bond number, employer, superior and declare
his flag before he gets any info from you. He is bound by the
INTERNATIONAL LAW OF THE FLAG to identify his country of origin and
if he does not identify himself then he can be considered an
impostor.
With
the TITLE 4 U.S.C.S. CH., SEC. 1 FLAG you are the SOVEREIGN and he is
actually your servant and is under your command. He might not be able
to appreciate the reality of that, so be nice. His job is to
convince you that there is no such thing, and try to get you to
contract with him(be under his command) by asking for a driver's
license DBA-”STRAWMAN”. If you are engaged in commerce,
such as driving a taxi, you are under his authority(admiralty) and
you better show him one. If you are not engaged in commerce, tell him
you are not engaged in commerce and ask if he can produce a
contract in which you agreed to follow the laws of the
corporation-state. He's gonna insist that you are
required to have one, if you don't, state simply:
“That
line of questioning assumes facts not in evidence.”
The
idea is to, in the most inconspicuous way, convince the patrolman
that he wants to leave you alone because you are a
professional(Sovereign Civilian Police Observation Task Force), with
the CERTIFIABLE KNOWLEDGE OF THE LAW, and that he does not want to
bring any bad publicity to his division. You
should politely educate the agent on his status as an employee
of commercial corporation, under commercial law; of your sovereign
status , that you reserve all of your rights under the UCC
1-207 “WITHOUT PREJUDICE” and that you cannot be mistaken
for a 14th amendment citizen. If you have a driver's
license with the reservation of rights on it, you should point out
the reservation to him.
If
he tries to interrogating you, hand him the “Traffic stop
notice” and the “Application to Question Detainee”
that are on the disk and politely tell him that you do not want to be
interrogated unless your counsel is present or he fills out the
application to question you. It's good to have all of these things
together on a clipboard or in a plastic envelope.
State
to the record: “I’m a Sovereign American Civilian and you
speak of commercial law. Here’s a commercial law Charter
Vessel Claim for my Life, my Proof of Sovereignty, the
notice to the Governor and Secretary of State, and my red, white
and blue TITLE 4 FLAG which is proof that I am with the
birthright inheritance to the organic Constitution for the fifty
American States united. Since you have taken an oath to uphold this
very Constitution and your authority only extends to Vessels of the
United States engaged in commerce you must acknowledge and stand
down. Failure to do so is a violation of the Sovereign Immunity Act
and an act of war on the American union.
He
might get it. You may have to break it down for him.
“That
line of questioning assumes facts not in evidence.”
“You
are on a time clock, you get paid with bank drafrt, and you collect
fines in insurance script, which means you are governed by the rules
of the UNIFORM COMMERCIAL CODE and you have no choice but to obey it.
Section 1-207 makes the provision, therefore I reserve all of my
common law rights WITHOUT PREJUDICE.”
“I
am Private, Sovereign, American, Civilian Life-Birth Party and I am
not a vessel of the UNITED STATES corporation as defined in Title 18
U.S.C. nor am I a corporate franchisee thereof. Are you getting paid
for this detainer? Is it in the form of a bank check?”
“See,
you are acting in the capacity of a CORPORATE FRANCHISEE. I
am not. You are engaged in a
commercial venture and I do not accept your offer. You must
obey the Uniform Commercial Code and stand down. The U.C.C. Is in the
first part of your State statutes. Go look it up 1.207.7 ”
“Did
you take an oath to uphold the Constitution for the American
union of States?”
“Do
you know that without an injured party detaining a Private
Sovereign American Civilian is in violation of that oath?”
“Would
you state that to the legal record under penalty of perjury,
or are you not quite sure?”
“Are
you familiar with Article 9 section 1 of the Constitution for
the united States of America?”
“How
can you uphold something that you are not familiar with?”
“Where
does your authority originate? what empowers you?”
“So
some guy with a checkbook and a business license pays you to wear
that costume?”
“And
your costume is where you get your authority?”
“Would
you state that to the legal record under penalty of perjury, or
are you not quite sure?”
“Who
signs your paychecks?”
“Can
you prove that I am a CORPORATE FRANCHISEE of the company you
work for or you’re not really sure about that?”
“Would
you state that to the legal record under penalty of perjury?”
“Thus
far you have not shown any proof of authority. I believe that you not
qualified because you cannot uphold your oath and are actually in
disguise as a patrolman which violates TITLE 18 U.S.C., CH. 13,
SEC. 241 For going in disguise on the highway to violate my rights
under color of law. Are you bonded? You know, insured in case
you injure me? What company? I would need to know who to file a claim
with if you injure me.”
“Does
your employer have a risk management division? Internal affairs?”
“This
stop should take no longer than 7 minutes.”
“Who
is your supervisor?”
“Am
I under arrest?”
If
he disrespects the flag, make note on the record and inform him that
disrespect for the flag is anti-American, a federal offense and that
he must honor the FLAG and your Sovereignty. If he does not honor the
TITLE 4 FLAG inform him that he must call a U.S. MARSHAL for a
CITIZENS ARREST. Most of the time he will honor the FLAG.
If
he isn't nice, politely ask him if he is new to the force, and
request that he call his superior officer to the scene because his
conduct appears to be unprofessional.
If
he gets belligerent with you and you have a cell phone, dial 911 and
report a civil rights violation and request a U.S. Marshal for a
CITIZEN'S ARREST. All 911 calls are recorded. Ask him if his
supervisor would be embarrassed or offended by his conduct.
Sometimes
a little humor is the best way to deal with them so as soon as you
hand them your info, ask them if it's gonna take more than 7 minutes
and if they could order a pizza cause you're pretty hungry.
If
he is new to the force he might think he's God and try to yank you
out of your vessel so you better have your door locked(always expect
it) always cry out in pain and describe the actions to the recorder
if he gets violent. It also makes them ease up before they really put
the torque on you.
If
he tells you that he's gonna arrest you say to him:
"I
was just passin’ through, I mean, you don't really want me
moving to this town for two years to teach all of the locals how to
be sovereign while I counter-sue for taking my time?", "by
the way, where's the food stamp office?", "do you guys have
any gas vouchers?" works pretty good too. You could always ask
him if he really wants you to inform the Governor of the little
extortion racket he's got going on here. - Use your imagination.
Expect
the unexpected. You may be kidnapped by a FOREIGN FLAG. If so, the
jail will likely want to get rid of you as soon as possible.
It
just depends on if they're smart or if they are dumb.
Say
another prayer.
Government
cannot break the law, by definition, for in Brookfield
Co. v Stuart, 234 F. Supp. 94, it was recognized that
"an...officer who acts in violation of the Constitution
ceases to represent the government."
However,
individual representatives of government can and do break the laws
pertaining to them, which is nothing less than treason, being a
violation of their oath of office.
You
have the right to remain silent; that is, do not answer any
questions, such as: What is your name? [My mother calls me son.]
Where do you live? [In a house.] What is your educational level? [I
can read, write and speak America’s English.] Where did you
attend school? [In a building.] What is your SS number? Are you
employed? Who is your employer? Are you married? Are you in insured?
What is your religion? Do you have any scars? Did you see that stop
sign?
"You
have the right to remain silent."
However, if you remain silent you will waive your rights, since only
a belligerent claimant can protect his rights. A claimant must
know his rights, and know how and when to claim those rights.
"There is a time to shut-up, a time put-up or speak-up and time
to run before the dealing is down!" Welcome to the Mad Hatter’s
tea party.
Miller
v US,
230 Fed 486,489 – "The
claim and exercise of a Constitutional (guaranteed) right cannot be
converted into a crime".
Now
when a government agent violates your rights, he loses his immunity
from prosecution -- IF IT'S HANDLED CORRECTLY. Of course, you have to
know what those rights are, or you'll never know if they're being
violated. So, we have included the Bill of Rights at the end of the
book.
When
a government agent is stepping outside the bounds wherein he would be
protected by "sovereign immunity", and he is violating your
right, you are required to tell him, to give him "constructive
notice" of his violation of law, just as he would inform YOU of
some of your rights if he were to arrest YOU. If you don't do that,
the courts will not entertain your lawsuit for damages later. You
have to tell him what rights he is violating, what laws he is
breaking, what the penalties are that he is risking, and what action
is open to him so that he doesn't break the law. If on giving him
notice, he corrects his error, then there is no need to take him to
court over any damages. We all are required to behave so as to
minimize damages to ANYONE, including ourselves.
First
make it clear that you protest the action, and it will be their
mistake if they deprive you of your rights under color of law. The
trick here is to make sure that you have not "consented" to
the interrogation or search.
Always
object. State “I cannot consent to that; for the record, I
object.”
An
officer has no authority until he proves it. If you let this
strange person do whatever they want without having determined their
lawful authority and their true identity by flag, you have
"consented", no matter how much you may verbally protest.
“There
can be no sanction or penalty imposed upon one because of this
exercise of Constitutional rights."- Sherar v. Cullen, 481
F. 945
